TERMS AND CONDITIONS

The terms and conditions are based on the contractual relationship between North Sea Camino ApS (hereinafter referred to as North Sea Camino) and the customer (hereinafter referred to as the customer) in connection with the booking of package tours.

The agreement is entered into and executed in accordance with the Danish Package Travel Act (Act No. 1666 on Package Travel and Linked Travel Arrangements).

1. The Agreement

The agreement for the purchase of a package tour between the customer and North Sea Camino is considered concluded and binding for both parties once North Sea Camino has registered and received the payment online.

The person who books the trip and thereby enters into the agreement with North Sea Camino is regarded as the primary booker. All changes, as well as any cancellations (no later than 15 days prior to arrival), must be made by the primary booker. Any fellow travellers wishing to make changes related to the trip must therefore do so through the primary booker. The primary booker is responsible for being reachable for important information via the contact details provided to North Sea Camino at the time of booking.

1.2. Age Requirement

North Sea Camino’s sale of package tours is intended solely for primary booking costumers who are 18 years of age or older. By purchasing experiences, the customer confirms that they are 18 years of age or above. There are no age restrictions on secondary travellers accompanying the primary booker.

1.3. Travel Documents

North Sea Camino will send the travel documents (order confirmation and a link to the personal booking page containing practical information about the holiday) to the customer once the agreement has been concluded. All travel documents and further correspondence between the customer and North Sea Camino will be sent to the email address provided by the customer at the time of booking. The travel documents will be available on the customer’s personal booking page no later than 3 weeks prior to the start of the holiday.

1.4. Contact Information

The customer is required to provide the necessary contact information to ensure that North Sea Camino can reach them both before and during the trip. If the customer does not receive the travel documents within 24 hours, they must contact North Sea Camino’s customer service immediately.

1.5. Review of Travel Documents

The customer is responsible for reviewing the received travel documents (the order confirmation) upon receipt and must immediately notify North Sea Camino if any of the information does not correspond with what was agreed upon.

2. Price and Payment

The price of the holiday is stated on northseacamino.com. The price of the trip is a so-called “total price,” meaning that taxes, duties, fees, costs, and any applicable surcharges are included. Unless otherwise stated, the price is per person.

2.1. Fees

At the destinations, local fees, entrance charges, and taxes may be collected which cannot be charged at the time of booking, as these payments are directly related to local regulations or the use of additional services not included in the agreement.

The total price of the trip is stated in the customer’s order confirmation. If any changes occur to the specific trip or its conditions due to circumstances related to the customer, this may result in a price adjustment, and additional payment may be required.

Costs related to insurance and similar services are not included in the price unless otherwise stated, and the responsibility for these lies solely with the customer.

2.2. Payment

The customer may pay using Visa, MasterCard, VISA, Maestro, Dankort, or MobilePay.

2.3. Agent and Contracting Party

North Sea Camino is the responsible tour operator and the customer’s direct contracting party, and is therefore considered the seller in accordance with applicable legislation. All complaints regarding the travel arrangement must be directed to North Sea Camino directly.

2.4. Cancellation Rights

In accordance with the Danish Consumer Contracts Act § 18, subsection 2, no. 12, the purchase of package tours on northseacamino.com is not covered by the right of withdrawal.

3. Rental of Equipment

The customer is solely responsible for any damage to, as well as theft or loss of, rented equipment, including bicycles and accessories, etc.

3.1. Luggage

All luggage must be securely packed in suitcases, bags, or backpacks. Each piece of luggage must be labeled with the provided tag, which must include the name of the primary booker (main contact person) and the relevant travel date.

Luggage such as foldable bike trailers, prams, strollers, and similar items may only be brought along by prior agreement with North Sea Camino, and often subject to an additional fee.

At departure, the customer is responsible for ensuring that all luggage is correctly checked in or brought along. The customer must also ensure that the luggage is collected from the bus at the destination. North Sea Camino does not assume liability for theft or loss of luggage when it is not in the care or under the direct supervision of North Sea Camino.

Electronics such as cameras and other valuable items, including jewelry, instruments, securities, etc., must not be stored in checked luggage but must be carried as hand luggage.

3.2. Lost & Found

A search for lost luggage is subject to a DKK 50 fee. For the return shipment of forgotten items, a fee of DKK 75 plus postage will be charged to cover handling and shipping costs.

4. The Customer’s General Obligations

4.1. Names on Travel Documents

The traveller is responsible for ensuring that the names stated in the travel documents and bookings match the full name as shown in the customer’s passport.

If the customer notices any discrepancies between the travel documents and the passport, this must be reported immediately to North Sea Camino, who will attempt to correct the error.

If the discrepancy is due to the traveller’s own actions, any resulting costs will be borne by the traveller. If changes cannot be made, the customer cannot hold North Sea Camino liable.

4.2. Timely Arrival

If the customer is unable to arrive on time for the booked travel service, the traveler must immediately contact North Sea Camino and inform them of the situation.

If the customer is unable to reach a satisfactory solution with the local service provider, they must contact North Sea Camino for further assistance.

4.3. Staying Informed

The traveller is responsible for staying informed about return travel times. This includes checking for any changes to the return schedule that may have been announced in the travel documents.

Notifications of such changes will be sent to the customer individually or posted at a pre-agreed location by North Sea Camino. In such cases, the customer cannot make any claims against North Sea Camino.

4.4. Rules of Conduct

The customer must comply with the rules of conduct applicable to all subcontractors involved in the package tour, including accommodations and means of transportation.

The customer is expected to behave considerately so as not to disturb fellow travellers. In cases of severe or repeated inappropriate behavior, North Sea Camino reserves the right to exclude the customer from further participation in the trip. In such instances, the customer is responsible for arranging and covering the cost of their own return transport.

In these cases, the customer is not entitled to any refund of the package tour price.

4.5. Failure to Comply

If the customer fails to comply with the requirements regarding correct names on travel documents, timely arrival, or rules of conduct, the customer cannot make any claims against North Sea Camino for any consequences or deficiencies resulting from the failure to fulfill these obligations.

5. Changes to the Agreement

5.1. Customer-Initiated Changes to the Package Tour

If the traveller wishes to make changes to the package tour, the customer must contact North Sea Camino as soon as possible. If the requested changes can be made, the customer will be responsible for covering any additional costs incurred as a result.

North Sea Camino is under no obligation to implement changes to the package tour. If the customer requests changes that North Sea Camino is unable to accommodate under the existing agreement, and the customer insists on proceeding, the change will be considered a cancellation of the package tour (cf. section 6.2), and a new booking must be made.

5.2. Changes Made by the Tour Operator Before the Start of the Package Tour

5.2.1. Minor Changes

North Sea Camino is entitled to make minor changes to the package tour prior to departure without the customer’s consent and without assuming liability.

The customer is obliged to accept such changes, provided North Sea Camino clearly and promptly informs the customer of the modifications without undue delay.

5.2.2. Other Changes

If North Sea Camino makes significant changes to the package tour before departure, is unable to provide certain services requested by the traveller and accepted by North Sea Camino, or increases the price by more than 8%, the customer has the following rights:

The customer may cancel the agreement and receive a refund of the amount paid for the trip.
If North Sea Camino offers it, the customer may participate in a replacement trip.

North Sea Camino is obligated to contact the customer without undue delay and inform them of the significant changes.

5.2.3. The Traveller's Participation in Cycling, Hiking, and Similar Activities

The customer’s participation in physically demanding activities, which are subject to weather conditions, is at their own risk. Weather conditions and other unforeseen events that result in necessary changes to the services offered cannot be considered a deficiency in the trip if they affect the services in such a way that they can no longer be used as originally planned.

6. Cancellation

If an experience purchased by the customer is cancelled, the customer will be refunded the purchase amount by the responsible organiser of the respective experience.

6.1. Cancellation (2)

An experience is considered cancelled only if it is not carried out by the organiser. Changes to the repertoire, date, execution of the experience, etc., are therefore not considered a cancellation. If there is a minimum number of participants required for the experience to take place, this will be communicated. If the necessary number of participants is not reached, the organiser is entitled to notify the customer, without liability, that the experience will not take place due to low participation.

6.2. Right of Withdrawal

There is no right of withdrawal for the purchase of package tours, in accordance with the Danish Consumer Contracts Act § 18, subsection 2, no. 1, and § 7, subsection 2, no. 5, which exempts passenger transport from the scope of the law.

6.3. Cancellation of the Package Tour

The customer can cancel the package tour no later than 15 days before departure and receive a full refund of the amount paid for the trip. Please note: A cancellation and handling fee of DKK 299 will be applied to all cancellations. However, this fee will be waived if the booking is rescheduled or moved to a different date within the same calendar year.

If the cancellation occurs after the deadline (15 days before departure), the amount paid will not be refunded. This also applies in the case of late arrival or failure to show up at the departure point.

6.4. Tour Operator's Termination

Termination Due to Unavoidable and Extraordinary Circumstances

North Sea Camino may terminate the agreement for a package tour without liability if we are unable to fulfill the agreement due to unavoidable and extraordinary circumstances. North Sea Camino will notify the customer of the termination without undue delay and no later than before the start of the package tour. The customer will receive a refund of the amounts paid no later than 14 days after the termination, but will not be entitled to compensation.

7. Deficiencies and Complaints

If a deficiency is discovered after the start of the trip—either during the journey or at the destination—the traveller must immediately file a complaint with North Sea Camino. If North Sea Camino offers to remedy the deficiency, the traveller cannot claim a proportional discount or cancel the agreement, provided the remedy is made within a reasonable time and without significant cost or inconvenience to the traveller.

8. Submission of Claims After the Completion of the Trip

Claims for compensation and/or a proportional reduction in the price of the holiday—due to deficiencies that have been properly complained about and not remedied by North Sea Camino—must be submitted within a reasonable time after the completion of the trip. If the claim is not made within this timeframe, the traveller loses the right to make a claim against North Sea Camino.

The customer may submit a complaint to North Sea Camino at info@www.northseacamino.com, stating the booking number.
North Sea Camino cannot be held liable for an amount exceeding the value of the experience certificate.

8.1. Liability

Claims for compensation and/or a proportional reduction in the price of the holiday—due to deficiencies that have been properly complained about and not remedied by North Sea Camino—must be submitted within a reasonable time after the completion of the trip. If the claim is not made within this timeframe, the traveller loses the right to make a claim against North Sea Camino.

The customer can file a complaint with North Sea Camino at info@www.northseacamino.com, providing the booking number.

North Sea Camino cannot be held liable for an amount exceeding the value of the experience certificate.

9. Disputes

The terms and any dispute that may arise in connection with them are subject to Danish law. For further information regarding online dispute resolution (ODR): http://ec.europa.eu/consumers/odr/.

10. Guarantee in the Travel Guarantee Fund

North Sea Camino has provided a guarantee for the refund of the traveller’s payments in the event of bankruptcy through the Travel Guarantee Fund. Membership number: 3330.
